1. Identification data

The Navarre Territorial Information System (SITNA) is a corporate organisation of the NavarreRegional Government, chaired by the head of the Information Systems Department of the Government of Navarre.

It is headquartered at the Directorate-General for Information Systems on 6, Cabárceno Street, Sarriguren 31621, Spain, and it comprises other public and private organisations under the terms set forth in the relevant collaboration agreements. In the terms of use described below, all references to SITNA should be extended to the Government of Navarre and the bodies that are part of it. This legal notice contains the general terms governing the access to and use of the resources, services and data sets offered through SITNA’s information media in the Internet subdomains:

By accessing the resources, services and data sets published on these two websites, the user accepts the terms of use, aimed at protecting and promoting SITNA’s commitment to the reuse of information in the public sector, and thus enabling users to contribute to community growth with the benefits of their use. The copyright of the contents published on these two websites belongs to the owners of the resources, services and data sets offered as shown in the relevant metadata, unless otherwise stated.

2. Legal terms of use

Unless otherwise stated, all of SITNA’s data sets are published under CC 3.0 licensing Creative Commons-Reconocimiento (CC-by 3.0), which means they can:

  • Be copied, redistributed and publicly shared.
  • Be built upon in derived works analysing or studying the material.
  • Be used for any purpose, even commercially.
  • Be remixed or transformed, indicating if changes were made.

Likewise, the reuse of the information contained in the data sets is subject to the following general terms:

  • Information content must not be altered.
  • Meanings must not be perverted.
  • Sources must be cited.
  • Updates must be mentioned (or at least updating frequency).

The acceptance of these terms of use does not entail the transfer of copyright over the resources, services and data sets. The organisations that are part of SITNA reserve the right to publish resources, services and data sets that require payment in order to be used. Said payment would cover the gathering, production, reproduction and dissemination of geographic information, which means it shall never be higher than necessary to cover these costs. Should this be the case, a list of applicable fees would be publicly available, together with the relevant amendments in the data dissemination policy.

3. Attribution

In accordance with the Creative Commons-Attribution 3.0 licence, in order to reuse, reproduce, adapt or redistribute SITNA’s resources, services or data sets, the user must give appropriate credit to SITNA (and to the owner of the information) as the source of data sets. This shall be indicated with this caption: ‘Data source: SITNA – Data owning organisation’. If the data owners are agencies or bodies belonging to the Government of Navarre, the caption shall read, ‘Data source: SITNA – Government of Navarre’. In the case of resources, services, information or data sets with multiple owners, a general caption shall be included: ‘Data source: SITNA’. If the source is cited in HTML, it can be specified as above or with a caption like the one below:

4. Changes in data sets and terms of use

At any time, SITNA can add, delete or change the data sets published and/or the contents of these terms of use. The changes may be announced on the websites. All changes shall become effective at the time of publication unless otherwise stated. All changes or transformations in the data sets published by SITNA shall be marked as at the time of distribution.

5. Data set guarantee

SITNA cannot offer guarantees for the information published on its websites. This shall be the responsibility of the owner(s) of said information. Therefore, SITNA cannot guarantee that the information is complete, accurate, up-to-date or accessible at all times. SITNA reserves the right to make changes without prior notice in order to correct, update, expand or transform the resources, services, data sets, contents and design on its websites. The reuse of these components shall be the sole responsibility of the user.

6. Liability disclaimer

Neither SITNA nor the organisations that are part of it shall be held responsible for losses or damages that are directly or indirectly caused by the use of the resources, services or data sets they offer, including financial losses, material damages or data alterations.

7. User’s responsibility for reuse

Users reusing data sets shall comply with the terms set forth in Law 37/2007, of 16 November, on the Reuse of Information in the Public Sector (in particular with regard to sanctions), with the regulations governing the use of information at large, with Organic Law 15/1999, in Personal Data Protection, and with Legislative Royal Decree 1/1996, of 12 April, approving the amended text of the Intellectual Property Law. Should the Government of Navarre or the organisations that are part of SITNA be subject to legal action or financial sanctions as a result of failure to comply with these terms of use or with the licensing terms under which the data sets are published, the individual(s) or organisation(s) using, reproducing, adapting or redistributing the data sets shall be held responsible for the legal procedures, sanctions or payments, whereas the Government of Navarre and the organisations that are part of SITNA shall not be held liable. By using, reproducing, transforming or redistributing the data sets, the user agrees to have the Government of Navarre and the organisations that are part of SITNA exempt from liability in connection with the failure to comply with these terms of use or with the mere use, reproduction, transformation or redistribution of information, and even pay compensation for damage whenever necessary. The Government of Navarre and the organisations that are part of SITNA reserve the right to take legal action in protection of their interests, without prejudice to the legal responsibility and/or the payment of compensation by the individual or organisation using, reproducing, transforming or redistributing their resources, services and/or data sets.

8. Unsupported reuse

Users shall not be entitled to publicly state, suggest or imply that the Government of Navarre or the organisations that are part of SITNA endorse, sponsor or support their specific use or reproduction of data sets. Moreover, they shall refrain from using written, graphic or audio visual signs that might mislead end-users to believe that the Government of Navarre or the organisations that are part of SITNA endorse or support their reuse of resources, services, information or data sets in particular.

9. Microdata

The Government of Navarre and the organisations that are part of SITNA shall not be held responsible for the information created by users on the basis of the microdata available on their websites. The users including said microdata in their work must give credit to SITNA as the source of the primary data, as described in clause 3 of these terms of use, and they must acknowledge their responsibility for the accuracy and reliability of the information created in this way (in accordance with the provisions of Legislative Royal Decree 1/1996, of 12 April, approving the amended text of the Intellectual Property Law, integrating, clarifying and standardising the current regulations in force in this area).

10. Additional information

Irrespective of individual users’ jurisdictions, this licence shall be governed by Spanish law. Should disputes arise over the interpretation of these terms of use, they shall be resolved at the Spanish courts.
